The Superior Taste Award (hereinafter "Award") is granted on a yearly basis by the International Taste & Quality Institute, 55 rue des Trois Ponts in 1160 Brussels (hereinafter "iTQi") with the aim of honouring and promoting superior tasting food and drink. iTQi juries are composed of Chefs, beverages experts, baristas and Sommeliers (hereinafter "Jury"), members of the major European culinary and sommeliers institutions.
The products evaluation carried out by iTQi (hereafter "Evaluation") is open to producers and retailers of food and beverage products (hereinafter "Products") from around the world (hereinafter "Participants").
By and when entering a Product, the Participant is presumed to be aware of and to have accepted all rights and obligations resulting from the present Evaluation Rules and Regulations.
1. Entry of the products
1.1 Each Participant is entitled to enter as many different Products as he desires (hereinafter "Entry"). The Entry can be done via the Online Entry Form on iTQi website or requested to iTQi via e-mail. The Entry will be considered as accepted when the corresponding invoice is paid and the Products are timely delivered for the Evaluation. Results of the tasting will not be disclosed to the Participant if the fee (hereinafter the "Entry Fee") is not paid in full.
1.2 A confirmation is sent via email when the payment of the invoice is received on iTQi's bank account.
1.3 The Categories of Products tested are described on iTQi website. Each Product submitted for the Evaluation (with some exceptions) must have gone through some transformation process. It must be specifically branded and regularly sold in grocery stores.
1.4 iTQi has the right to cancel an Entry if the Product entered does not belong to a Category of Products tested by iTQi, doesn't meet minimum quality standards or if the quality control documents are not satisfactory for iTQi. In that case, iTQi will inform the Participant via e-mail and reimburse the invoice if already paid.
2. Delivery of Product samples
2.1 Product samples (hereinafter "Samples") have to be shipped according to the Samples Delivery Instructions as indicated on iTQi Website. Samples delivered must be fully identical as the products sold on the market, i.e. having the same content, packaging and labelling. The Products need to be delivered in their best conditions and within their expiry date of consumption.
2.2 An official quality control certificate for each Product must be provided at the latest together with the shipment of the Samples.
2.3 Delivery costs, taxes, import and Customs duties for shipment to iTQi's office are at the sole expense of the Participant.
2.4 iTQi shall in no way be liable for any unsuccessful shipment, or damage to/(partial) loss of the Samples.
2.5 Each Participant will receive an e-mail confirmation once Products are actually delivered to iTQi.
3. Evaluation by iTQi
3.1 iTQi will submit the Samples to the Jury for Evaluation.
3.2 The Jury is composed of independent members, who have equal voting rights.
3.3 iTQi Jury uses a proprietary tasting methodology for evaluation of Products. The main principles are as follows:
• Products are evaluated following sensory analysis criteria with an emphasis on first gustatory impression and taste.
• Products do not compete against each other but are rather evaluated on their proper gustatory merits.
• Each Product is judged blindly i.e. with no indication about its origin, without packaging and without revealing the Participant's or the brand-owner's name.
• The Product is evaluated by each and every Jury member. The judges are not authorized to communicate between themselves at any time during the tastings. They score each specific organoleptic (sensory) criterion and write comments or suggestions on a specified form (hereinafter the "Sensory Analysis Form"). The global mark based on a 100 points scale results from a weighted average consolidation of the individual organoleptic scores.
• iTQi limits its Evaluation to assessing criteria about the intensity of gustatory pleasure and does not judge the quality of the ingredients of the Products. The quality and sanitary control of the Products and their production process are the sole responsibility of the Participant.
3.4 Within one (1) month as from the Evaluation, the Participant receive for each Product a sensory analysis graph showing the global and specific marks per organoleptic criterion. The graphs will be sent before the end of April via e-mail together with the announcement of the results of the tastings.
At the time of its Products Entry, the Participant may opt to order a report containing a summary of the comments or suggestions made by the Jury. This report is sent by the end of July of the Evaluation year.
3.5 The decisions made by the Jury are final and binding, without possibility of appeal for Participants.
3.6 The names of the Jury members having participated to the individual Product Evaluation will not be disclosed. Participants are not authorized to contact Jury members without iTQi's prior written express consent. The list of the Jury members can be seen on www.itqi.com.
4. Superior Taste Award ®
4.1 iTQi will grant an Award to successful Products (hereinafter "Awarded Products") according to the following classification into three (3) types of Awards:
• 3 golden stars award for exceptional Products with a global mark of 90% and above,
• 2 golden stars award for remarkable Products with a global mark between 80% and 90%,
• 1 golden star award for notable tasting Products with a global mark between 70% and 80%.
The global mark is the result of a weighted average mark of the different sensory analysis criteria evaluated by the panel of tasters.
4.2 No Award will be granted to Products with less than a 70% overall score.
5. Crystal Taste Award ®
iTQi will grant a Crystal Taste Award to Products having won a 3 golden stars award 3 years consecutively. This is the highest acknowledgment granted by iTQi.
6. Confidentiality
iTQi will not publish information on Products or Participants that have not been awarded, and undertakes to maintain the confidential nature of every Entry until an Award is granted.
The official list of Awarded Products with the name of Participants is published on iTQi's website. Only the lists of the last three (3) years are communicated.
7. Use of the Award
7.1 The Use of the Award is limited to a period of three (3) years.
7.2 All Awarded Products will receive a Certificate, a Medal and a Label, as set out below
7.3 For all Awarded Products, the granting of the Award will be officially materialized in the form of a dated certificate (hereinafter "Certificate"), stating the name of the Product, the Participant and the number of stars granted.
7.4 The granting of the Award entitles the Participant to receive the Award medal issued by iTQi, displaying iTQi's logo and the year of the Award (hereinafter "Medal").
7.5 The granting of the Crystal Taste Award entitles the Participant to receive a crystal trophy and the Crystal Taste Award Certificate.
7.6 The granting of the Award entitles the Participant to receive the Award label issued by iTQi, displaying the year of attribution and the number of stars (hereinafter "Label"). The graphic file of the Label in high resolution image format and in 13 languages as well as pictures of the tests will be made available to each awarded Participant.
7.7 The granting and use of the Award will depend on and be formalized in accordance with a free Licence Agreement to be executed to that end (See Appendix 1).
As owner of all right, title and interest in and to the Award registered trade mark and associated names, logos and graphics (hereinafter 'Licensed Marks'), iTQi will grant a non-transferable, non-assignable and non-exclusive limited licence to those Licensed Marks for Awarded Products.
Once awarded, Participants will be requested to sign the License Agreement before having access to the License Marks.
7.8 To preserve the integrity and credibility of the Award, its usage is governed by the following rules and every successful Participant subscribes to it in full:
• The Certificate, Medal and Label cannot be modified in any way or at any time without iTQi's prior written express consent. Any communication about the Award must obligatorily and visibly specify the type of Award received with the applicable number of stars and the year of attribution.
• The Certificate, Medal and Label shall be exclusively linked with and restricted to the sole Awarded Products and to no other products or to the Licensee's company in general.
• In case of a material change to the Product, its ingredients or manufacturing process, the Participant shall immediately inform iTQi in writing. The Product will need to be reassessed in order for the Participant to keep the right of usage of the Award, and the Participant undertakes to suspend its use of the Award until successful re-evaluation of the modified Product.
8. Limitation of Liability
8.1 iTQi shall not bear any responsibility or liability, financially or otherwise, with respect to any Product liability claim. The Participant shall hold iTQi harmless from any such claim from any third party whatsoever. The Participant shall compensate iTQi for any damage, direct or indirect, including damage to reputation and costs, iTQi would suffer with respect to any such claim. This Participant's guarantee towards iTQi includes, but is not limited to, claims related to an abusive, erroneous or misleading usage of the Award by the Participant.
8.2 In no event shall iTQi be liable whether in contract, tort, by statute or otherwise for any loss of profits, indirect, special, incidental or consequential damage arising out of or in connection with the Award.
8.3 No Party shall be deemed in breach of these Evaluation Rules and Regulations, if it is unable to fulfil its obligations, including the failure to provide the Award, by reason of fire, earthquake, strikes, act of God, death, illness or incapacity, acts or requirements of government authorities, war or other hostilities, riot or civil commotion, embargo any other event beyond its control (collectively referred to as ‘Force Majeure Event'). Upon occurrence of any Force Majeure Event, the Party hit shall promptly give written notice to the other Party of its inability to perform or of delay in fulfilling its obligations. In case the force majeure continues to exist for 30 days, the other Party will have the right to terminate the Agreement without having to pay compensation.
9. Severability
9.1 Whenever possible, each provision of this Agreement shall be interpreted in such manner as to be effective and valid under applicable law.
9.2 In case any clause or part thereof of this Agreement is held invalid or unenforceable, this will not affect the validity of the remaining clauses or parts thereof, which will remain in full force and effect. Moreover, the Parties undertake to renegotiate in good faith a new clause replacing the original one, maintaining the initial purpose and, to the extent possible, having an equivalent result, in order to re-establish the contractual balance between the Parties.
10. Governing Law and Jurisdiction
10.1 The Award and the Evaluation Rules and Regulations shall be governed by, construed and enforced in accordance with Belgian Law.
10.2 Any dispute arising from or in connection with the Award or the Evaluation Rules and Regulations, will be settled amicably. In case of a dispute for which no amicable solution is possible, such dispute shall be submitted to the exclusive jurisdiction of the Commercial Court of Brussels.
